Owner Consent
When listing your property for sale you hereby confirm that you have authorisation from all legal owners and occupiers of the property, and any person with an interest in the marketing and or sale of the property, to do so.
You also confirm that you have authorisation from the same, to accept a purchasers offer subject to contract, and proceed to exchange legally binding contracts.
Identification
You will be asked to provide identification (name and address) and a video verification to confirm that you legally own the property prior to UB Sold listing your property. Identification documents will typically be your passport, photo driving licence or mortgage statement, which can be uploaded as an attachment or you can take a picture.
UB Sold may carry out a ‘Know Your Customer Check’ (KYC) using your ID document to ensure compliance with Money Laundering Regulations.
Energy Performance Certificate
You must provide UB Sold with a valid Energy Performance Certificate (EPC). If you do not have an EPC UB Sold can arrange for this to be completed at an additional cost.
Property Details
You must ensure that all property details submitted via the UB Sold platform are a true and accurate representation of the property you are selling. UB Sold will need to approve the listing before going live on the platform and reserve the right to request additional information from you in order to satisfy accuracy and content standards.
UB Sold reserves the right in all cases to refuse photographs, videos or descriptions that are inaccurate, inappropriate or misleading to prospective buyers.
Once a listing has been approved then it will go-live as soon as reasonably practicable.
Viewings
You will be responsible for arranging viewing appointments with the interested parties, all of which is done through the app.
Offers
If an offer is accepted then a Memo of Sale will be generated and shared with the respective solicitors, however this can only be done if both the seller and buyer have input the details of their solicitor into the app.
The Memorandum will include the details of the property being sold, agreed price and the solicitors details that are representing each party.
General Data Protection Regulation (GDPR)
The lawful reasons UB Sold uses to process personal data are set out in Article 6 of the Regulation and with respect to the business model undertaken by UB Sold, our processing is lawful given that at least one of the following applies:
– the data subject has given consent to the processing of his or her personal data for one or more specific purposes (Consent).
– processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract (Contract Performance).
– processing is necessary for compliance with a legal obligation which we are subject to (Legal Obligations).
– processing is necessary for the purposes of the legitimate interests pursued by UB Sold, except where our interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child
Sharing Information
In accordance with the GDPR regulations outlined above and to ensure viewings can be scheduled at your listed property(s) UB Sold will share your basic contact information with buyers who have enquired about your property. This information will include the name, email address and contact phone number you have provided on the UB Sold platform.
We may share information with third parties so that they can assist us in providing our services; selected third parties could include, Suppliers and sub-contractors for the performance of a contract/order. Suppliers and sub-contractors for the performance of a contract, or (by way of example) supplying your details to an energy assessor to allow them to contact you and arrange a date and time to visit the property at which the service has been ordered.
Additional Services
If instructed by you UB Sold will enlist third party contractors to carry out works such as energy performance certificates, floorplans, conveyancing, mortgage advice, and marketing boards. UB Sold may receive referral commission payments from third party suppliers as part of your transaction.
Whilst UB Sold endeavour to work with trusted and reputable suppliers we will not be held liable for any grievance or complaint towards a third party supplier.
‘For Sale’ Boards
If requested by you UB Sold will arrange for a marketing board to be erected outside the address provided via a third-party contractor. We will also arrange for the board to be collected once requested by you the client at any point during or after marketing. UB Sold accept no liability for any damage caused by the erection or removal of marketing boards.
Cancellations
You can withdraw your listing at any time.
Services to Prospective Purchasers
UB Sold, or a connected person or firm may offer and/or provide to the prospective purchasers of your property related services such as insurance, financial services or conveyancing.
Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our app and the way we expect users to behave on our app. We will notify users by email of changes to these Terms and Conditions or post a notice on our site and app.
Age Restrictions
The minimum age to use our app is 18 years old. By using the application, users agree that they are over 18 years old. We do not assume any legal responsibility for false statements about age.
Limitation of Liability
UB SOLD LIMITED and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the app.
Indemnity
Except where prohibited by law, by using this app you indemnify and hold harmless UB SOLD LIMITED and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our app or your violation of these Terms and Conditions.
